Here’s a thoughtful piece by Jon Stewart that he wrote up when he realized that if you combine the Shrub’s new policy of continuing to relax the last 30 years of EPA regulations with last week’s (undoubtedly unconstitutional) Amendment that was passed in one of the Houses banning burning the flag as a form of political speech, it would appear that the flag is the only thing you aren’t allowed to burn in the U.S.

Huh? A constitutional amendment, by definition, can’t be unconstitutional. It may be dumb (e.g., Prohibition), and I agree this one is unwise and unlikely to be adopted. But there is no judicial review of constitutional amendments, and if adopted, an amendment is perforce not only small-c constitutional, but integral to the big-C Constitution.But I suppose if you’re getting your “news” from the Daily Show, that point probably is a bit too reality-based for you.
